Introduction
These are the terms and conditions of use (Terms) for the Seglo platform, including all websites, subdomains, mobile sites, and mobile applications (collectively, the Platform). Seglo Inc. (we, us, and our) operates the Platform to connect customers with beauty, wellness, and personal care businesses.
Your use of the Platform will be subject to these Terms and by using the Platform you agree to be bound by them.
These terms and conditions of use apply to your use of the Platform for browsing, booking appointments, and managing your bookings. These terms DO NOT apply to the services provided by businesses you book through our Platform. Those services are subject to the policies of the individual businesses.
We may change these Terms from time to time by updating them on the Platform. Your continued use of the Platform following the posting of changes will mean that you accept and agree to the changes. As long as you comply with these Terms of Use, Seglo grants you a personal, non-exclusive, non-transferable, limited privilege to enter and use the Platform.
Privacy
If you use our Platform, Seglo's Privacy Policy applies and forms a part of these Terms of Use. We are committed to protecting your personal information in accordance with the Privacy Act 1988 (Cth) and Australian Privacy Principles. Unfortunately, the transmission of information via the internet is not completely secure. We do our best to protect your personal information, but we cannot guarantee the security of your data transmitted to us. Any transmission is at your own risk.
Access to the Platform
It is your responsibility to ensure your equipment (computer, laptop, tablet, mobile device, or other device) meets all the necessary technical specifications to enable you to access and use the Platform and is compatible with the Platform.
You must ensure that any registration details you provide are accurate. If you choose, or you are provided with, a log-in ID (such as a username and password or other identifier) as part of our security procedures, you must treat such information as confidential and must not reveal it to anyone else. You are responsible for all activities that occur under your log-in ID and must notify us immediately of any unauthorized use or other security breach of which you become aware. We reserve the right to disable any log-in ID, at any time, if in our opinion you have failed to comply with any of the provisions of these Terms or if any details you provide for the purposes of registering as a user prove to be false.
Age Requirements
You must be at least 18 years of age or the age of majority in your jurisdiction of residence in order to use the Platform and make bookings. If you live in a country or area that limits the use of the Platform because of your age, or restricts the ability to enter into contracts such as this one due to age, you must abide by such age limits and you must not use the Platform, or only do so with your parent or legal guardian's permission. Please have your parent or legal guardian read these terms with you. If you are a parent or legal guardian, and you allow your child or dependent to use these services, then these terms apply to you and you are responsible for your child's or dependent's activity on the Platform.
Accounts and Security
You do not need an account to browse the Platform, but you may need an account to make bookings or use certain functionality on the Platform.
Each individual may only have one account on the Platform. Your account is non-transferable and may not be sold, accessed by, combined or otherwise shared with anyone else.

We reserve the right to hold you liable for any and all damages caused by your conduct, to pursue legal action through relevant local and national law enforcement authorities and to notify your payment provider of any fraudulent activity we associate with you or your use of the Platform.

Your Promises to Us
Use authorized apps and devices: You may only access the Platform using authorized means. It is your responsibility to check to ensure you download the correct App for your device. Seglo is not liable if you do not have a compatible device or if you download the wrong version of the App for your device. Seglo reserves the right to terminate your access if you are using the Platform with an incompatible or unauthorized device.
Comply with the law and these terms: You must only use the Platform and anything available from the Platform for lawful purposes (complying with all applicable laws and regulations), in a responsible manner, and not in a way that might damage our name or reputation or that of any businesses using our Platform.

What You Are Not Allowed to Do

Seglo may involve and cooperate with law enforcement authorities in prosecuting users who violate these Terms. You acknowledge that Seglo has no obligation to monitor your access to or use of the Platform or to review or edit any content, but has the right to do so for the purpose of operating the Platform, to ensure your compliance with these Terms, or to comply with applicable law or the order or requirement of a court, administrative agency or other governmental body.
If you breach any part of these Terms, all your rights under these Terms will terminate immediately.

The Platform allows you to submit reviews and feedback about services you have received.
You are solely responsible for the content of your reviews and feedback. All reviews express the views of their respective authors, and not Seglo's views.

You agree that by submitting reviews, feedback or other content to Seglo, you grant us and our affiliates a perpetual, irrevocable, worldwide, non-exclusive, royalty-free and fully sub-licensable right and license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform and display such content (in whole or part) and/or to incorporate it in other works in any form, media or technology.
We reserve the right, in our sole discretion, to delete, edit or moderate any review or feedback submitted by you, at any time without notice to you.
Complaints about the content of any review or feedback must be sent to our support team and must contain details of the specific content giving rise to the complaint.
Intellectual Property
Seglo alone (and its third party licensors, where applicable) shall own all right, title and interest, including all related intellectual property rights, in and to the Platform (including text, graphics, software, photographs and other images, videos, sound, trademarks and logos).
These Terms do not constitute a sale and do not convey to you any rights of ownership in or related to the Platform, or any intellectual property rights owned by Seglo. Seglo's name, logo, and product names are trademarks of Seglo or third parties, and no right or license is granted to use them.
Except as expressly set out here, nothing in these Terms gives you any rights in respect of any intellectual property owned by us or our licensors and you acknowledge that you do not acquire any ownership rights by using the Platform.
Platform Content
We may change the format and content of the Platform from time to time. You agree that your use of the Platform is on an 'as is' and 'as available' basis and at your sole risk.
While we try to make sure that information contained on the Platform is correct, it is not intended to amount to authority or advice on which reliance should be placed. Information about businesses, services, pricing, and availability is provided by the businesses themselves, and Seglo does not guarantee its accuracy. You should verify important details with the business before making a booking.
External Links
The Platform may include links to external sites, including business websites and social media profiles. We include these to provide you with additional information you may find useful. We are not responsible for the content of these sites or for anything provided by them and do not guarantee that they will be continuously available. The fact that we include links to such external sites does not imply any endorsement of or association with their operators.
Disclaimers
Seglo provides a platform to connect customers with businesses. We do not provide the actual beauty, wellness, or personal care services, and we are not responsible for the quality, safety, or legality of the services provided by businesses.
We make or give no representation or warranty as to the accuracy, completeness, currency, correctness, reliability, quality, or fitness for purpose of any content on the Platform, and to the fullest extent permitted by law, all implied warranties, conditions or other terms of any kind are hereby excluded and we accept no liability for any loss or damage of any kind incurred as a result of you or anyone else using the Platform or relying on any of its content.
While we try to keep the Platform safe and secure, we cannot and do not guarantee that the Platform will be free from viruses and/or other code that may have contaminating or destructive elements. It is your responsibility to implement appropriate IT security safeguards (including anti-virus and other security checks) to satisfy your particular requirements.
We may, from time to time and without notice, restrict access to certain features or content of the Platform, or the entire Platform.
We cannot guarantee the continuous, uninterrupted or error-free operation of the Platform. There may be times when certain features, parts or content of the Platform, or the entire Platform, become unavailable (whether on a scheduled or unscheduled basis) or are modified, suspended or withdrawn by us, in our sole discretion, without notice to you. You agree that we will not be liable to you or to any third party for any unavailability, modification, suspension or withdrawal of the Platform, or any features, parts or content of the Platform.

Australian Consumer Law
If you are a consumer under the Australian Consumer Law, certain consumer guarantees apply to the supply of goods and services which cannot be excluded, restricted or modified except to a limited extent. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you may have under the Australian Consumer Law or any other applicable law that cannot be lawfully excluded, restricted or modified.
Governing Law and Dispute Resolution
These Terms, and any dispute between you and us regarding these Terms or the Platform, shall be governed by the laws of Australia and the state or territory where Seglo is registered. You agree to submit to the non-exclusive jurisdiction of the courts of that state or territory.
Except where excluded by applicable law, any claim under these Terms of Use must be brought within one (1) year after the cause of action arises, or such claim or cause of action is barred.
In the event of any controversy or dispute between Seglo and you arising out of or in connection with your use of the Platform, the parties shall attempt, promptly and in good faith, to resolve any such dispute. If we are unable to resolve any such dispute within a reasonable time (not to exceed thirty (30) days), then either party may pursue any right or remedy available to them under applicable law.
Geographic Restrictions
Seglo is based in Australia, where it administers and operates the Platform. Although the Platform may be accessible from other locations, not all features, products or services discussed, referenced, provided or offered through the Platform are available to all persons or in all geographic locations. Seglo may, in its sole discretion, limit the use of any feature, product or service to any person or geographic area. Any offer for any feature, product or service made on the Platform is void where prohibited. If you choose to access the Platform from outside Australia, you acknowledge you have chosen to do so independently and you are solely responsible for complying with applicable local laws.

General Provisions
Entire Agreement
These Terms, along with our Privacy Policy, constitute the complete agreement between you and Seglo regarding your use of the Platform.
Modifications
We may update these Terms from time to time with notice posted on the Platform. Continued use of the Platform after such notice constitutes acceptance of the modified Terms.
Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in effect.
No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
Assignment
You may not assign or transfer these Terms or your account to any other person. We may assign our rights and obligations under these Terms without restriction.
